1.Acceptance of These Terms

These Terms of Use ("Terms") form a binding agreement between you and LIMBIC APPS YAZILIM LTD STI ("Mendly", "we", "us", "our") governing your use of the Mendly iPhone app, its Apple Watch companion, and its widgets (together, the "App"). By downloading, installing, or using Mendly, you agree to these Terms. If you do not agree, do not use the App.

2.The Service

Mendly is a relationship app for couples. It lets two people pair their devices to share daily questions, playful "pokes," shared photo memories, and structured rituals for reconnecting after a disagreement, with optional AI-generated conversation starters and a premium subscription tier. Features may be added, changed, or removed over time.

3.Eligibility

You must be at least 18 years old, and capable of entering into a binding contract in your jurisdiction, to use Mendly. By using the App, you represent that you meet these requirements.

4.Your Account & Pairing

Mendly creates an anonymous account for your device automatically — no email or password is required.
You may be paired with only one partner at a time. Pairing is initiated by sharing a short code between two devices, which you agree to share only with the person you intend to pair with.
You are responsible for anything that happens through your device while it is signed in to your Mendly account.
You may unpair from your partner at any time in Settings. Unpairing stops future content sharing between the two accounts.

5.User Content & Conduct

"User Content" means anything you submit through the App — question answers, episode accounts, photos, pokes, and similar material. You retain ownership of your User Content. By submitting it, you grant Mendly a worldwide, non-exclusive license to host, store, transmit, and process it solely as needed to operate the App — principally, to share it with your paired partner and to send it to the service providers listed in our Privacy Policy (for example, to generate AI content from it).

You agree not to use Mendly to:

Upload or send content that is illegal, harassing, abusive, or that violates another person's rights, including images of anyone other than yourself or your partner without their consent
Upload any content involving minors in a sexual or exploitative context — this is strictly prohibited and will be reported where required by law
Impersonate another person, or pair with someone under false pretenses
Attempt to reverse-engineer, disrupt, or gain unauthorized access to the App or its backend systems
Use the App for any purpose other than your own personal, non-commercial use

We may remove content or suspend accounts that violate these Terms.

6.AI-Generated Content Disclaimer

Certain features (conversation-opening sentences, weekly questions, relationship "archetype" cards, guess verdicts) are generated using third-party AI models based on text you and your partner provide. This content is algorithmically generated, may be imperfect or occasionally inaccurate, and is provided strictly for personal reflection and conversation between you and your partner.

Mendly is not a substitute for professional relationship counseling, therapy, or psychological advice. If you and your partner are experiencing serious relationship difficulties, or if either of you is in crisis, please seek qualified professional help.

7.Subscriptions & Purchases

Mendly offers optional premium features through:

An auto-renewing monthly subscription, which may include a free trial period as shown at the time of purchase
A one-time lifetime purchase

A single active purchase or subscription unlocks premium for both members of a pair for as long as they remain paired.

All purchases are billed through your Apple ID / App Store account. Exact pricing and billing period are shown before you confirm any purchase.
Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period. Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period, at the price you agreed to.
You can manage or cancel your subscription any time in iOS Settings → [your name] → Subscriptions. Cancelling stops future renewals but does not refund the current period.
If offered, a free trial converts automatically into a paid subscription unless cancelled before the trial ends.
Refunds are handled by Apple under its own refund policies; Mendly does not directly process payments or refunds.

8.Intellectual Property

The Mendly name, logo, design, and all software, text, and other materials we provide (excluding your own User Content) are owned by LIMBIC APPS YAZILIM LTD STI or its licensors and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial use, subject to these Terms.

9.Third-Party Services

Mendly relies on third-party services described in our Privacy Policy (Firebase, RevenueCat, OpenAI, OpenRouter, and Apple). We are not responsible for the availability, content, or practices of these third-party services beyond our use of them to operate Mendly.

10.Disclaimer of Warranties

Mendly is provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or free of harmful components, or that any AI-generated content will be accurate or suitable for your circumstances.

11.Limitation of Liability

To the maximum extent permitted by applicable law, LIMBIC APPS YAZILIM LTD STI shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, goodwill, or relationship outcomes, arising from your use of or inability to use Mendly, even if advised of the possibility of such damages. Our total liability for any claim arising from these Terms or the App shall not exceed the amount you paid us, if any, in the twelve months preceding the claim.

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

12.Termination

You may stop using Mendly and request deletion of your account at any time (see our Privacy Policy). We may suspend or terminate your access if you violate these Terms, engage in abusive conduct toward your partner or our systems, or as required by law. Sections that by their nature should survive termination (including Sections 8, 9, 10, 11, and 14) will survive.

13.Apple-Specific Terms

If you downloaded Mendly from the Apple App Store, you acknowledge and agree that:

These Terms are between you and LIMBIC APPS YAZILIM LTD STI only, not with Apple Inc., and Apple is not responsible for the App or its content.
Apple has no obligation to furnish any maintenance or support services for the App.
In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the App to you; to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App.
Apple is not responsible for addressing any claims by you or any third party relating to the App, including product liability claims, any claim that the App fails to conform to legal or regulatory requirements, or claims arising under consumer protection or similar legislation.
Apple is not responsible for the investigation, defense, settlement, or discharge of any third-party claim that the App or your possession and use of it infringes that third party's intellectual property rights.
You represent that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties.
Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance, Apple has the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.

14.Governing Law

These Terms are governed by the laws of the Republic of Turkey, without regard to conflict-of-law principles, except where mandatory local consumer protection law requires otherwise. Any dispute arising from these Terms or the App shall be subject to the exclusive jurisdiction of the courts of Turkey, except where applicable law requires a different venue.

15.Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will update the "Last updated" date above and, where appropriate, notify you in the App. Continued use of Mendly after changes take effect constitutes acceptance of the revised Terms.
